Weekly Free Movement Newsletter Update
Welcome to the latest edition of the Free Movement newsletter! Today, we dive into recent developments in immigration policy, current events affecting asylum seekers, and insights from our blog. Let’s unpack the important topics shaping the landscape right now.
Upcoming Government Amendments
It’s been announced that the government will introduce further amendments to the Border Security, Asylum, and Immigration Bill. This initiative, as outlined by the Home Office, includes increased penalties for those providing immigration advice without proper regulation. Notably, it will close a loophole that previously allowed individuals, barred from giving immigration advice, to operate under “supervision.” While the specific amendments haven’t yet been published, we expect these details to emerge soon.
U.S. Involvement in the Rwanda Agreement
In an unexpected twist, reports have surfaced indicating that the U.S. has sent an Iraqi national to Rwanda, with plans to send additional individuals there. This particular case highlights how the U.S. may be stepping in to fulfill some obligations of the UK’s controversial Rwanda agreement, especially for individuals who cannot be safely returned to their countries. A U.S. embassy cable suggested that Rwanda’s motivation for accepting such transfers includes improving relations with the U.S. and aligning with the America First agenda. It raises the question: how much financial support is the U.S. providing for these arrangements, especially considering the substantial funds already disbursed by the UK?
Positive Developments in Asylum Policies
On a brighter note, our blog highlighted a significant win for Asylum Aid, which successfully challenged the family reunion rules impacting stateless individuals. This outcome offers hope and marks a step in the right direction for those seeking asylum and the right to family life.
In another development, the High Court recently ruled in favor of a recognized refugee who challenged a negative trafficking decision. The judge’s dismissal of the Home Office’s argument—claiming that the case couldn’t proceed due to the man’s refugee status—emphasizes the complexities that often arise in trafficking cases and the importance of protection rights.
Challenges Faced by Asylum Seekers
Our discussions also brought to light a troubling case where a woman, working at a nail salon on a skilled worker visa, successfully challenged the cancellation of her leave due to failures on the part of the Home Office. These ongoing issues underscore the systemic problems within immigration processes that affect vulnerable individuals.
